Definitions

"Conditions" means these terms and conditions and the Special Conditions; "Product" means a product displayed for sale on the Website; "Product Description" means that part of the Website where certain terms and conditions in respect of the individual Product are provided; "Special Conditions" means the terms and conditions in the Product Description; "Users" means the users of the Website collectively; "Personal Information" means the details provided by you on registration; "We/us" means Active 4 Less; "Website" means the website located at http://www.myclubonline.net/stevenage/ or any subsequent URL which may replace it; "Cookies" means small text files which our Website places on your computer's hard drive to store information about your shopping session and to identify your computer ; "United Kingdom" means England, Wales, Scotland, Northern Ireland and the Channel Islands and "You" means a user of this Website.

1. Definitions

1.1 The Club: as indicated on the application form.
1.2 The Club Rules:The rules and regulations of the club, as amended from time to time, displayed at the club reception.

2. Membership Applications

2.1 Persons wishing to become members of the club shall complete the Membership Application Form and submit it to Active 4 Less. Active 4 Less reserves the right to reject any application for membership without giving any reason for so doing. By signing the Membership Application Form the member agrees to comply with these Terms and Conditions of Membership and the Club Rules.

3. Membership Definitions

3.1 Active 4 Less offers the following categories of membership, not all categories are available at all clubs:
Peak: For a person 16 years or over, unlimited use of facilities during opening hours.
Family: For husband and wife or partners living together at the same address, with up to two children under 18 years.
Friends & family: Two adults paying by a single monthly DD or annual payment, unlimited use of facilities during opening hours.
Off Peak: Use of club is limited to the times published in the club.
Senior: For a person 60 years or over, unlimited use of facilities during opening hours.
Student: For a person under 25 years in full time education, unlimited use of facilities during opening hours.
Corporate/Group:A minimum of three named employees or group members from a single organisation, unlimited use of facilities during opening hours (Active 4 Less reserves the right to decline applications).
Junior: Not available at all clubs, restrictions do apply ask for further information.
Swimming: Not available at all clubs, restrictions do apply to other club facilities, ask for further information.
3.2 Active 4 Less offers the following types of membership:
Monthly Direct Debit saver: For a minimum period of twelve months. Once the twelve months period has expired, a member may terminate his/her membership by giving at least 30 days notice in writing to Active 4 Less. Membership fees shall be paid monthly in advance by Direct Debit.
Monthly Direct Debit flexible: For a minimum period of three months. Once the three months period has expired, a member may terminate his/her membership by giving at least 30 days notice in writing to Active 4 Less. Membership fees shall be paid monthly in advance by Direct Debit.
Annual advance For a period of twelve months. Membership fees shall be paid annually in advance.

4. Fees

Active 4 Less will set the level of fees and reserves the right to change the level of fees from time to time.The following fees prevail:
4.1 Membership fee
The level of membership fees shall be determined according to the type and category of membership.
4.2 Joining fee/Activation
charge Upon joining the club all new members shall pay a joining fee and activation charge.
4.3 Guest user fee
A fee will be set by Active 4 Less from time to time in respect of guests of members who wish to visit the club and use the facilities.
4.5 Other Fees
All other fees and prices for the sale of goods at the club, locker rental, solarium, bar/restaurant and any other services will be set by Active 4 Less from time to time.
4.6 Membership Fees, Joining Fees, Activation Charge and Guest User Fees are not refundable by Active 4 Less under any circumstances.

5. Suspension of Membership

A Member may, if he/she is unable to make use of the club facilities by reason of illness or injury, suspend his/her membership for one continuous period of at least 1 month. 30 days written notice must be given to Active 4 Less and Active 4 Less shall have the right to request a doctor's certificate. A reduced monthly fee will be charged by Active 4 Less during the suspension of membership.

6.Termination of Membership by Active 4 Less

Active 4 Less reserves the right to terminate membership:
6.1 without notice in the event of repeated or serious breach of the Club Rules or the Membership Terms and Conditions;
6.2 on at least 7 days' notice in writing, in the event of any other breach of the Club Rules or the Membership Terms and Conditions, including, but not limited to, the non-payment of any fees owing to Active 4 Less within 14 days of their due date.

7. Guests

7.1 Guests accompanied by a member will be admitted on payment in advance of the Guest Fee.
7.2 Members who wish to be accompanied by more than 2 guests must book with the club in advance.
7.3 Members must accompany their guests at all times and members shall not leave the club premises before their guests.
7.4 All guests must sign the guest book and the appropriate Physical Activity Readiness Questionnaire.
7.5 Active 4 Less reserves the right to refuse admission to a guest for reasons of health and safety or if the proposed guest has previously not complied with the Club Rules.

8. Membership Card

8.1 Membership cards shall be issued to all members upon joining the club and are to be used to gain entry to the club. Membership cards are not transferable and any members allowing their card to be used by another person is in serious breach of these Membership Terms and Conditions and will entitle Active 4 Less to terminate membership without notice in accordance with Clause 6 above.
8.2 If a membership card is lost, it should be reported to Active 4 Less and Active 4 Less reserves the right to charge an administration fee for the provision of a replacement membership card.

9. Club Rules

Active 4 Less may amend the Club Rules from time to time in order to ensure the health and safety of members. Temporary amendments will be displayed in the club reception area. Permanent changes to the Club Rules will only be made after at least 30 days notice to members, except in the case of emergency. If the proposed changes are not acceptable to a member, he/she may terminate his/her membership on 30 days notice in writing to the club.

10. Conduct

10.1 Members must wear appropriate clothing and shoes in the club and trainers when using the equipment in the gym.Training shoes must be worn during exercise classes unless the class instructor specifically authorises otherwise.
10.2 In the interests of health and hygiene members are requested to shower before entering the pool, whirlpool, steam or sauna areas.
10.3 Members must not:
10.3.1 Abuse the equipment or facilities of the club. Any wilful, negligent or deliberate damage to club property must be paid for.
10.3.2 Behave in a disorderly, violent or rude manner or in a manner which causes or is likely to cause offence or distress to other members or staff of the club.
10.3.3 Smoke in the club.
10.3.4 Bring or consume alcohol or drugs in the club.
10.3.5 Use the facilities of the club whilst under the influence of alcohol or drugs.

11. Opening Hours

11.1 The club's opening hours, as amended from time to time, are displayed at the club reception.
11.2 Members must ensure they cease use of the club facilities at least 30 minutes before the club closes to
allow adequate time for showering and dressing.

12. Restriction of Liability

12.1 Active 4 Less will not accept liability for any loss, damage to or theft of money, valuables or other personal property of members and guests. Property stored in lockers provided by the club is stored at the owner's risk and no liability for loss or damage thereto will be accepted by Active 4 Less.
12.2 Save as provided in clause 12.3 Active 4 Less accepts no liability for any damage, accident or injury or other loss sustained by members or guests on the club premises.
12.3 Active 4 Less accepts liability for death and personal injury to the extent caused by its negligence or the negligence of its employees and agents (during the course of their employment and agency, as appropriate).

13. Physical Activity Readiness Questionnaire

13.1 Upon joining the club all new members are required to complete and sign a Physical Activity Readiness Questionnaire.The purpose of this is to ensure that the club's staff are fully informed of any physical or medical condition which could affect the member's ability or suitability to take part in physical activities. Only if the club's staff are fully and accurately informed, can they assess the member's health and fitness level and prepare an appropriate exercise programme.
13.2 Active 4 Less strongly recommends that all members seek medical advice before commencing a new exercise programme and Active 4 Less reserves the right to request a doctor's certificate and to reject a membership application if a satisfactory doctor's certificate is not received by Active 4 Less.

14. Health & Safety

Members must read all Health and Safety notices displayed in the club and comply with their recommendations.

15. Miscellaneous

15.1 Active 4 Less reserves the right to alter the operating, offpeak access hours of the club, provided that Active 4 Less shall always attempt to give at least 30 days notice to all members of any permanent change in these hours.
15.2 Active 4 Less reserves the right to adjust the availability of certain facilities on a temporary basis for the general purpose of cleaning, decorating, essential repairs, maintenance of equipment, special functions and holidays.
